These Terms & Conditions (“Terms”) govern your use of postopcollective.com (the “Site”), operated by The PostOp Collective LLC (“The PostOp Collective,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
In an emergency, call 911. The Site, our forms, and our messaging are not monitored for emergencies and must not be used for urgent medical needs.
Content on the Site is for general information. It is not medical advice and does not replace advice from your surgeon or physician. Using the Site, submitting a form, or messaging us does not create a nurse-patient or provider-patient relationship. Always follow your surgeon’s post-operative instructions.
We provide private post-operative nursing and concierge recovery services, including in-home and hotel nursing, overnight care, IV therapy, lymphatic massage, and coordination of transportation and hotel stays. Services are provided under a separate service agreement and are subject to a consultation, availability, and a review of your needs and your surgeon’s care plan.
Requesting a consultation does not guarantee that we can provide services on a particular date. Pricing, payment, cancellation, and other service terms are discussed during your consultation and set out in your service agreement. If anything in your service agreement conflicts with these Terms, the service agreement controls.
We work with independent partners, including surgical practices, hotels, and private transportation providers. These partners are not owned or controlled by The PostOp Collective, and their services are governed by their own terms. Mentioning a partner on the Site does not mean we are responsible for their services.
You agree to use the Site only for lawful purposes. You will not:
When you contact us, you agree that we may reply by email, phone, or text message. For texts, message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for help. See our Privacy Policy for how we handle your information.
Reviews and testimonials on the Site reflect the experiences of individual clients and partners. Recovery experiences vary from person to person, and testimonials are not a promise of any particular outcome.
The Site and its content, including text, photography, graphics, logos, and design, belong to The PostOp Collective or its licensors and are protected by copyright and trademark laws. You may view and print pages for your personal use. Any other use requires our written permission.
The Site may link to websites we do not control. We are not responsible for their content, policies, or practices.
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties about the Site, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will always be available or free of errors.
To the fullest extent permitted by law, The PostOp Collective and its owners, staff, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred dollars ($100). This section applies to your use of the Site only. Services you receive from us are governed by your service agreement.
You agree to indemnify and hold harmless The PostOp Collective from claims, losses, and expenses, including reasonable attorneys’ fees, that arise from your misuse of the Site or your violation of these Terms.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute related to the Site will be brought in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time. When we do, we will change the effective date above. Your continued use of the Site after changes are posted means you accept the updated Terms.
